At Lamar State 大学 Port Arthur, we take sexual misconduct (in all its forms) extremely 认真. Therefore, if any 正规靠谱赌博软件 employee, supervisor, or faculty member ("Responsible 员工") is aware of an allegation of discrimination or sexual misconduct, they are required to report 事件s to 第九条协调员. 

 

Reporting to Responsible 员工s 

Before a victim or reporting party reveals any information to a Responsible 员工, the employee should ensure that the victim or reporting party understands the employee’s 报告义务. If the victim or reporting party requests anonymity and confidentiality, the Responsible 员工 should refer the victim to a Confidential 员工. 

If the victim or reporting party reports an 事件 to the Responsible 员工 but also requests confidentiality or requests that the matter not be investigated, the employee should tell the victim that the 大学 will consider the request but cannot guarantee that the 大学 will be able to honor it. 在报告的细节 事件 to 第九条协调员, the Responsible 员工 will inform the Title IX Coordinator of the victim or reporting party’s request for confidentiality.

Responsible 员工s are employees of 正规靠谱赌博软件 that are engaged in the course and scope of their employment, including Campus Security. All 正规靠谱赌博软件 employees are responsible employees, except for Confidential 员工s. Confidential 员工s have been designated as being able to take confidential reports of sexual misconduct, including sexual harassment, sexual assault (including rape and acquaintance rape), domestic violence, dating violence, relationship violence, or stalking, without having to report the victim’s identity or other confidential information to 第九条协调员. 

Responsible 员工s must comply with their obligation to promptly report sexual misconduct, including sexual harassment, sexual assault (including rape and acquaintance rape), domestic violence, dating violence, relationship violence, or stalking, to 第九条协调员. They must report all relevant details about the alleged sexual misconduct shared by the victim or reporting party.

A Responsible 员工 shall share all information relevant to the investigation, and if applicable, redress of the 事件, including whether an alleged victim or other necessary parties have expressed a desire for confidentiality in reporting the 事件.

A Responsible 员工 should not share information with law enforcement without the victim or reporting party’s consent unless the victim or reporting party has also reported the 事件 to law enforcement.

A Responsible 员工 is required to report under the following conditions:

  • the employee is in the course and scope of employment, at the time the employee witnesses or receives information regarding the occurrence of sexual harassment, sexual assault, dating violence, or stalking, or any other sexual misconduct defined in this Policy; 而且,
  • the employee reasonably believes the 事件 constitutes sexual harassment, sexual assault, dating violence, or stalking, or any other sexual misconduct defined in this policy; 而且,
  • the 事件 of sexual harassment, sexual assault, dating violence or stalking or any other sexual misconduct defined in this policy, was either committed by or against an enrolled student or an employee of the component at the time of the 事件.

A Responsible 员工 is not required to report under the following conditions:

  • the person was the victim of such conduct; or,
  • the person received information due to a disclosure made at a public awareness event sponsored by 正规靠谱赌博软件 or another TSUS member institution or by a student organization 隶属于正规靠谱赌博软件.
